Chapter 2: House of Representatives Apportionment Act of 2010

3-2-1. This law shall be known and may be cited as the “House of Representatives Apportionment Act of 2010.”

 

3-2-2. For purposes of this act:

(a) “Enrollment” is the head count enrollment during the fall semester one year previous as provided by the Tennessee Higher Education Commission.

(b) “Representation Ratio” is the Enrollment of a college divided by the number of seats it has been allocated in the House of Representatives.

(c) “Unclaimed Seats” are seats apportioned to a particular college for which no delegate has registered as of midnight on the first day of the General Assembly.

 

3-2-3. Seats in the House of Representatives shall be apportioned proportional to Enrollment with respect for minimum and maximum delegation size as may be set forth in the TISL Constitution.

 

3-2-4. Seats in the House of Representatives shall be allocated in the following manner:

(a) First, the mandatory minimum seats set forth in the Constitution will be allocated to each college participating in the General Assembly.

(b) Second, the remaining seats shall be allocated one at a time, each to the college with the largest Representation Ratio, recalculating the Representation Ratio as each additional seat is allocated until all seats in the House of Representatives have been apportioned among the participating colleges. The goal is to minimize the variation between the college with the largest Representation Ratio and the college with the smallest Representation Ratio.

 

3-2-5. Unclaimed Seats shall be allocated in the same manner as the initial apportionment among colleges with delegates present and eligible to sit in the House of Representatives in excess of the number of House seats that college has otherwise been allocated and respecting the maximum number of seats for each college set forth in the Constitution. The allocation of Unclaimed Seats shall be read in open session when the House convenes on the second day of the General Assembly, although the results may be published earlier.

1. Provided, however, that bonus seats shall first be assigned to colleges that registered for the General Assembly after the House is initially apportioned.

 

3-2-6. The Speaker, Speaker Pro Tempore and Chief Clerk of the House of Representatives shall supervise the apportionment of the House of Representatives.

 

3-2-7. The calculations used to allocate seats in the House of Representatives shall be open to inspection by any delegate.
